Ett rationellt förhållningssätt till hat och hot på nätet

EU arbetar som bekant med sin nya Digital Services Act – som bland annat kommer att sätta upp regler som rör hot och hat på nätet.

Låt oss hoppas att EU-kommissionen lyssnar till David Kaye –som är »UN Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression«.

I sin senaste rapport ger han uttryck för en oro för att nätföretag och stater kan komma att inskränka grundläggande fri- och rättigheter i sin iver att hantera verkliga och upplevda kränkningar på nätet. EDRi förklarar…

»Firstly under the legality criteria, Kaye uses human rights law to show that any regulation of hate speech online (as offline) must be genuinely unlawful, not just offensive or harmful. It must be regulated in a way that does not give “excessive discretion” to governments or private actors, and gives independent routes of appeal to impacted individuals. Conversely, the current situation gives de facto regulatory power to internet companies by allowing (and even pressuring) them to act as the arbiters of what does and does not constitute free speech. Coupled with error-prone automated filters and short takedown periods incentivising over-removal of content, this is a free speech crisis in motion.«

Danmark: Datalagringen igång igen efter att allvarliga brister avslöjats

Uppenbarligen är den danska regeringen lika skamlös som den svenska när det gäller datalagring. EDRi rapporterar…

»In March 2017, in the aftermath of the Tele2 judgment, the Danish Minister of Justice informed the Parliament that it was necessary to amend the Danish data retention law. However, when it comes to illegal data retention, the political willingness to uphold the rule of law seems to be low – every year the revision is postponed by the Danish government with consent from Parliament, citing various formal excuses. Currently, the Danish government is officially hoping that the CJEU will revise the jurisprudence of the Tele2 judgment in the new data retention cases from Belgium, France and the United Kingdom which are expected to be decided in May 2020. This latest postponement, announced on 1 October 2019, barely caught any media attention.«

Inte nog med att man struntar i EU-domstolen:

»However, data retention has been almost constantly in the news for other reasons since 17 June 2019 when it was revealed to the public that flawed electronic communications data had been used as evidence in up to 10000 police investigations and criminal trials since 2012. Quickly dubbed the “telecommunications data scandal” by the media, the ramifications of the case have revealed severely inadequate data management practices by the Danish police for almost ten years. This is obviously very concerning for the functioning of the criminal justice system and the right to a fair trial, but also rather surprising in light of the consistent official position of the Danish police that access to telecommunications data is a crucial tool for investigation of criminal offences. The mismatch between the public claims of access to telecommunications data being crucial, and the attention devoted to proper data management, could hardly be any bigger.«

Live kl 15: Hearing i Europaparlamentet om hat, hot, fake news och yttrandefrihet

Idag kl 15 kåller utskottet för medborgerliga fri och rättigheter m.m. (LIBE) en hearing om hat, hot, fake news och yttrandefrihet – såväl online som i den fysiska världen.

»Measures to fight hate speech and disinformation, without putting at risk media freedom, will be the focus of a public hearing in the Civil Liberties Committee.«

»MEPs will then discuss how to deal with hate speech, both online and offline, and the spreading of false information with representatives of non-governmental organizations (NGOs) and think tanks working to address the issue.«

Live kl 15:30: Europaparlamentet håller hearing om AI

Europaparlamentets utskott för rättsliga frågor (JURI) anordnar idag en hearing om etik och artificiell intelligens – som streamas live för den som är intresserad.

»MEPs will also hold an exchange of views on Ethics in Artificial Intelligence at 15.30 with Andrea Renda, member of the High Level Experts Group on Artificial Intelligence (AI HLEG).«

Politisk kontroll över AI känns som en fråga som man bör hålla ögonen på.

EU ger Europol 5M€ för att knäcka kryptering och 5G

The „Innovation Laboratory“ is to build on existing departments at Europol. Its areas of responsibility include the police handling of anonymisation and encryption on the Internet and Darknet. Europol has already set up a „decryption platform“ for this purpose, which is being funded by the EU Commission with 5 million euros. Europol is researching the use of quantum computers that could be used for artificial intelligence applications within the framework of the „Innovation Laboratory“.

The „Innovation Laboratory“ will also be responsible for the search for methods for intercepting the 5G mobile radio networks, which are by default interception-proof. Europol has already organised several „expert meetings“ on this subject.

Tyskland stiftar pre-crime-lag mot hat och hot på nätet, EU väntas följa efter

Tyskland är på väg att skärpa sina redan hårda lagar mot hot och hat på nätet. Politico rapporterar…

In proposals published Wednesday, Angela Merkel’s government announced new measures to force social media platforms to proactively report illegal content such as death threats or incitement of hatred on their platforms to law enforcement. That follows complaints that it takes too long to follow up on harmful content because police must wait until people file official charges.

Berlin will also create a new federal police unit to handle the submissions, and companies will be required to hand over the IP address, or online identifier, of those publishing hateful material.

Frågan är hur detta skall gå till rent praktiskt. Under den gällande NetzDG-lagen skall anmält olagligt material plockas ner inom 1-7 dygn. Men om plattformarna måste agera proaktivt – då kräver detta rimligen automatisk granskning av allt som laddas upp. Och problemen med automatisk, algoritmdriven filtrering är redan väl kända.

Den nya tyska lagstiftningen kan för övrigt komma att bli vägledande för hela EU:

Within the European Commission, officials are considering similar efforts as part of the so-called Digital Services Act that is expected to overhaul the level of responsibilities that digital players must hold for what is circulated online. That comes as Brussels is pushing for greater efforts to clamp down on terrorist content, as well as greater efforts by social media companies to stop the spread of misinformation online.

Frankrike och Tyskland vill skapa europeisk molntjänst

Reuters:

»France and Germany are stepping up efforts to foster homegrown rivals to U.S. tech giants Amazon and Microsoft in cloud computing, according to a joint statement by the countries’ finance ministries issued on Tuesday.«

»Previous French government-supported attempts to build a so-called “sovereign” cloud to store the most sensitive data held by companies and states failed.»

Man skulle också kunna tänka sig att EU slutar stifta omöjliga regler som driver europeiska IT-företag och riskkapitalister ut ur Europa, till andra delar av världen.

Frankrike: Länkskatt för Google men inte för Facebook

EU:s nya upphovsrättsdirektiv innehåller bland annat den så kallade länkskatten – det vill säga att sökmotorer, plattformar m.fl. förväntas betala en avgift om de länkar till tidningars och mediehus artiklar. Vilket är lika besynnerligt som det låter. Först ut med att göra nationell lag av detta är Frankrike – som genast hamnat på kollisionskurs med Google.

Google vägrar och har istället för »rika länkar« gått över till att endast länka till franska media med artikelns rubrik och URL. Den franska regeringen rasar och vill tvinga Google att visa mer utförliga länkar och då också betala för detta. Läs mer: 1 » | 2 » | 3 » | 4 »

Nu meddelar även Facebook att de vägrar. Men reaktionen från Frankrike har inte blivit den man kan vänta sig. Politico förklarar:

Facebook’s refusal to pay for news in France under new legislation on the neighboring right for publishers does not have the same consequences as Google’s refusal, French Junior Digital Minister Cédric O said Monday.

”Facebook doesn’t raise the same issues [as Google]. Facebook doesn’t generate the same traffic, it’s not a search engine,” he told French radio France Inter.

Ministern medger i vart fall att Google är en sökmotor. Vilket rimligen innebär att de inte är en publicist. Vilket däremot Facebook möjligen är. Här någonstans bryter logiken samman. Om någon över huvud taget skall betala »länkskatt« – då är det väl den som publicerar länkar på sin plattform, snarare än den som hjälper människor att hitta web-sidor värda att besöka?

”In their news tab, [Facebook] decided to reference some quality media and to provide remuneration, which is closer to the spirit of the directive on neighboring rights,” said Cédric O, adding that the news tab raised other types of questions such as the social media giant’s potential role as ”censor.”

Detta kan vara en viktig ledtråd. Facebook skriver avtal med ett fåtal större media, vars innehåll de sedan lyfter fram på siten. Det innebär att alla andra media, mindre publikationer och alternativa media missgynnas. Vilket minister O tydligen också inser – men inte drar några rimliga slutsatser av.

Bortsett från att det hela luktar välkänd fransk elitism, så är den franska regeringens position inte helt lätt att förstå.

EDRi om den nya EU-kommissionen och de digitala frågorna

Den Brysselbaserade gruppen för digitala rättigheter, EDRi, har sammanfattat Europaparlamentets utfrågning av de nya EU-kommissionärerna.

Om den nya svenska kommissionären Ylva Johansson skriver man så här:

Sweden’s Ylva Johansson, Commissioner-designate for Home affairs, will inherit a portfolio including cybercrime, terrorist content Regulation and issues relating to privacy and surveillance. Whilst her hearing was relatively light on digital questions, it was certainly heavy in evasive answers. Her insistence on fundamental rights was a good start, but her call for compromise between security and privacy fell into the age-old myth of the two rights as mutually exclusive.
